This rental terms and conditions is applied to www.inspiringvillas.com operated by Inspiring Properties Limited and/or representative (IV) trading as www.inspiringvillas.com “InspiringVillas” Booking a Private Property is very different from booking a regular hotel room, please read the following conditions carefully.
All bookings are made with Inspiring Properties and/or representative (collectively known as "IV"), acting as agents on behalf of the owners of the properties featured in the company website or via other platforms. The payment of any deposit for the booking shall be taken as confirmation of acceptance under the following terms and conditions.
Bookings will be made on a 'first-come, first-served' basis and must adhere to the minimum nights’ requirement according to the stay period, unless otherwise specified in the confirmation of availability. Upon receipt of a request confirmation of availability, the applicable Villa rates and the amount of deposit required will be advised. IV reserves the right to decline a booking request without giving any reason.
The payment of any deposit for the booking shall be taken as confirmation of acceptance under the following terms and conditions.
TERM OF PAYMENT
Before the booking is confirmed and a contract becomes enforceable, IV reserves the right to increase or decrease the agreed prices. No contract will exist, agreed & accepted between the guest and the villa owner before the received of funds.
When booking a villa less than 6 months in advance, a minimum deposit of 50% must be paid to confirm a booking, unless otherwise special specified in the villa terms and conditions may apply. This deposit payment is non-refundable.
If you are booking a villa more than 6 months in advance, a 25% deposit must be paid to confirm a booking. The additional 25% of the deposit will be requested 6 months prior to your stay.
Payment is due in full no later than 45 days before your arrival date or 60 days prior to arrival (stay periods of high season, which is Chinese New Year, Easter, Christmas, and New Year, and any other periods which are notified at the time of confirmation).
The reservation shall be deemed cancelled If the funds have not been received by IV within five (5) banking days from the booking date and Inspiring Villas or the villa owner reserves the right to allocate the Villa to another customer, in which case this Rental Contract will be thereby terminated without any further notice required.
Payment can be made either via international bank transfer, nett of bank fees, or using IV’s online payment gateway (administration charges of 3% is may applicable). If the payment is made via bank transfer, a scanned copy of bank transfer or payment confirmation slip is required. For the avoidance of doubt, all bank charges and administration fees are to be borne by the customer.
In case the customer makes a payment via credit card link. The customer will authorize InspiringVillas to charge the credit card according to the booking detail/invoice/Credit card link and the terms outlined above. This payment authorization for the goods/services described above. The customer certify that I am an authorized user of this credit card. I will not dispute/chargeback the payment with my credit card company so long as the transaction corresponds to the terms indicated in this form/booking detail.
If IV does not receive the balance by the due date, IV reserves the right to cancel the booking and cancellation charges may apply as detailed below.
The cancellation will take effect from the day the written confirmation is received (email acceptable) unless otherwise special specified in the villa terms and conditions may apply. The following cancellation charges will be applicable depending on when the notification of the cancellation is received in writing and the period of stay in the Villa.
All cancellations made by the Client and/or Guests are subject to penalties below :
A) If the Client and/or Guests cancels the reservation more than 45 days prior to arrival date, all payments are forfeited but credited for 9 months from the date of the cancellation confirmation by the Lessor.
• Credit will be based on the booking value paid.
• Rebooking will be at the same villa under the same client or anyone on his or her behalf.
• Rates/promotions, inclusions and booking terms for new bookings will follow terms in place at the time of rebooking.
• Any unused credit will not be refunded and if the booking value is higher, the difference must be paid.
• Once new dates are agreed and confirmed for your future villa stay, we will transfer your past credit to these new dates. From this stage, your stay will be considered as a ‘new’ booking and regular terms and condition will apply.
B) If the Client and/or Guests cancels the reservation within 45 days or less prior to arrival date, all rental payments are forfeited.
C) Christmas and New Year Period, for any cancellation after the deposit and/or balance payment, all payments are forfeited.
D) For no-show: 100% of the total rental amount will be forfeited.
The above cancellation charges also apply if the Client and/or Guests cancels the booking due to non-payment of the balance.
Once a booking conﬁrmation, a fee of $50 USD will apply in the event of refund and amendment to reservation when reschedule are made to an existing booking which applicable with the same villa only. If the dates of the booking require to be changed or amended, this may be treated as a cancellation of the original booking and cancellation charges may apply. Any change to the original reservation is subject to the approval of IV. An early departure penalty will be subject to negotiation with IV as well.
In case the price of the new amended booking period is less than the original booking, the difference will not be reimbursed to the Renter. However, if the price of amended booking period is higher than the original booking, the difference may be charged to the Renter. Inspiring Villas will do its best to accommodate any reasonable amendments, but the Guest should be aware that some changes may not be possible.
Regarding to the event that InspiringVillas cannot accommodate the villa booked by the Renter for any reason including the sale of a property and force majeure, Inspiring Villas reserves the right to transfer the Renter to an alternative villa of the similar type and value. If the price of the alternative villa is less than the original booking, the difference will be reimbursed to the Renter. However, if the price of the new amended booking period is higher than the original booking, the difference may be charged to the Renter.
However, for any reasons beyond IV’s control that could result in IV being unable to provide the Guests with the Villa booked, SVH reserves the right to cancel the reservation.
For example, but not inclusive, if any properties are damaged or rendered unusable, IV will endeavour to relocate the Guests to an alternative property for the period required but no guarantee is provided that this can be done. In the event that this is not possible, or if the Guests do not wish to be transferred, IV will cancel the booking and refund in full, less any bank transfer charges, the amount paid to IV for the Villa. IV shall not be liable for any further obligations or claims by the Guest or client for any consequential or incidental damages, including travel expense, alternative lodging, or other expense.
EXCLUSIONS & ADDITIONAL COSTS
The rates do not include baggage handling, gratuities, telephone, fax and telegram charges, car rental, food, soft drinks and/or liquor, personal items, expenses due to any other third parties and any excessive cleaning required upon departure (such as upholstery or rug shampooing, etc.) or replacement of breakages. Fair wear and tear accepted.
The cost of electricity, Wireless Internet, mains water, cleaning and garden supplies, and local taxes are included in rental rates. Only provisioning costs plus 20% surcharged of shopping bill will be the Guest’s responsibility. Gratuities for household staff are encouraged and normal, but are left entirely to the Guest’s discretion.
ARRIVAL / DEPARTURE TIMES
Typical check-out and check-in times are 12:00 noon and 3:00 PM unless otherwise special specified in the villa terms and conditions may apply. Any early arrival or late departure will depend upon the availability of the Villa at the time of arrival or departure. An additional fee may be applicable and will be advised at the time of booking.
Guests are responsible for informing the correct arrival details (flight number) whenever an airport transfer is being offered as part of the booking.
The standard security deposit required for each Property is varies, which is stated in the Property description. Guest can pay directly to the Owner before arrival or Owner’s Representative immediately upon arrival at the Property. Access to the Property may be refused if security deposit is not paid in full. We accept the security deposit in any of currency equivalent of requested amount in USD. The security deposit will normally be refunded at the end of the rental period, after deducting all additional expenses incurred on the Guest’s behalf during guest’s stay or the cost of replacement or repair for any loss or damage to the Property
DAMAGE OR LOSSES
A Property is typically someone’s home. Please treat the Property rented accordingly, and leave the Property and all its contents in good order and in an acceptably clean condition. Any damage or losses caused during the Rental Period, as well as any special cleaning requirements will be the Guest’s responsibility and may be charged to the Guest’s account and deducted from the Guest’s security deposit. In cases of excessive or unacceptable loss or damage at any time during the Rental Period, the Owner or Owner’s Representative may require the Guest and their party, including visitors to vacate the Property immediately, without compensation or refund.
The Property and its facilities are available for the Guest’s full enjoyment during the Rental Period. However the Owner, Owner’s Representative, or other staff and contractors may need access to the Property from time to time (e.g. for maintenance purposes to the house, garden, swimming pool, utilities and services, or for the purposes of providing additional services requested by the Guest, etc.). The Guest is required to give them reasonable access to the Property for these purposes.
Only the specified number of persons listed in the Rental Agreement at the time of booking may reside on the premises. The number of registered guests given at the time of the booking is the maximum number of persons allowed, including children, must not exceed the maximum capacity indicated in the property description or elsewhere, except in the case of infants (under two years old), or unless specifically authorised which must be approved at the time of booking. If the Lessor or a representative of the Lessor will find out that an additional number of guests are staying at the property, it is the absolute discretion of the Lessor or the representative to ask the extra person or persons to vacate the premises. Otherwise, each additional person will be charged a published rate of $300 USD per night or the rate stipulated from the respective villa.
MINIMUM STAY REQUIREMENTS
There is a minimum 3 days stay requirement for most of the year unless otherwise special specified in the villa terms and conditions may apply. During peak seasons (Christmas & New Year), the minimum stay is from 7 to 10 days. For holidays such as Easter and Chinese New Year, the minimum stay is 5 days. This may not be applicable to some villas.
WEDDINGS & EVENTS
All bookings are assumed to be for normal holiday purposes only, (No sublets or assignments) and the Guest agrees that the use of the Property will be limited to this purpose unless otherwise confirmed in writing. If the Guest is planning to hold an event, such as a wedding or party, which involves having exceeded maximum number of guest allowed at each villa, please communicate this to Inspiring Villas at the time of booking, as special approval or arrangements may be required based on each villa. Some villas may or may not allow weddings on the premise.
It is a mandatory condition of the booking that the Client and/or Guests is covered by comprehensive All Risk Travel Insurance (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including evacuation and repatriation coverage). IV or the owners of the rented properties should not be held liable by the client or the Guest and the Guest’s party against all claims including any accidents related to the use of the Villa facilities or locally procured third party services such as, but not limited to, watercraft, water sports, jeep or motorbike rental. IV shall not be responsible for any delay, additional expense or inconvenience caused directly or indirectly by events outside of IV's control such as civil disturbances, fires, floods, severe weather, pandemic outbreak, Acts of God, acts of Government, etc.
By acceptance of this contract it is assumed by IV that this requirement has and will be complied with in full.
All villas come with staff service during your stay at the villa unless otherwise special specified in the villa terms and conditions may apply. Additional services such as babysitting and drivers can be arranged by our concierge team before arrival and are subject to availability. The Client and/or Guests must allow staff such as pool maintenance workers and gardeners access to the grounds in order to complete their work.
There is a ‘No Pet Policy” in the villa and on surrounding properties.
Strictly no smoking permitted in the villa. Smoking must be done outside, where an ash tray provided. If signs of smoking are found a $ 500 cleaning fee will be charged per day. Smoking is a breach of the rentals contract and can lead to the cancellation of the booking with no compensation.
FOOD AND BEVERAGES
All food and beverages purchased on behalf of the guests are charged at a price of cost plus a 20% surcharge that covers food preparation, transportation, time involved in the shopping and cooking process, and the use of the kitchen unless otherwise special specified in the villa terms and conditions may apply. Bills for food and drinks are expected to be cleared periodically and before departure.
LINENS AND TOWELS
Linens and towels are changed every three (3) days unless otherwise special specified in the villa terms and conditions may apply. Additional charges may apply if more frequent changes are needed. Items such as bedding, washing, or clothing articles should not be hung where it is visible to another residence or common property on the estate. Laundry of personal clothing by a third party can be arranged at the lessees cost, the Lessor cannot take responsibility for any loss of damage by the third party.
Transfers may be arranged through the Villa Concierge with applicable fees.
CONDUCT AND DUE CARE
Properties are generally located in quiet residential neighborhoods. The Guest is asked to respect this, and ensure that all guests and visitors to the Property behave appropriately. Illegal or immoral activities including gambling, prostitution, prohibited drugs, possession or use of pyrotechnics or dangerous goods, and possession or use of firearms and other weapons are all strictly prohibited. Smoking is generally prohibited unless stated otherwise in the booking confirmation or reservation voucher.
The Guest is responsible for the behavior of the guests staying at the Property, as well as visitors to the Property during the Rental Period. Should any guest(s) or visitor(s) not behave in a suitable manner, the Owner or Owner’s Representative may, in their absolute discretion, require the Guest, their party and/or visitor(s) to leave the premises and/or vacate the Property immediately, without compensation or refund
In the interests of safety, due care should be taken at the Property at all times, especially with children. Suitable supervision should be given around pools, beaches and roads, and when using all Property’s facilities.
VALUABLES AND SECURITY
Any Guest valuables or property left or used at the Property are at the Guest’s own risk. Neither Inspiring Villas, the Owner nor the Owner’s Representative accepts any responsibility for loss of or damage to Guest property. The Guest is responsible for the Property during the Rental Period, and must ensure that all windows and doors are locked securely when not on the premises. Any act or omission by the Guest, their party and/or visitors which may negate or prejudice the Property’s insurance policy and/or results in loss or damage is the Guest’s responsibility.
Each Villa varies in standard, quality and finishing and there are differences in style and decor. Property descriptions as provided by IV, on the website and elsewhere, are made in good faith.
SVH accepts no responsibility for any modifications made which are not mentioned on the website or anywhere else. IV, the villa owner and/or the local representative cannot be held liable for the breakdown of the supply of water, or electricity, or internet connection nor of swimming pool filtration systems, though IV will use its best endeavours to arrange for any such problems to be solved quickly.
If there are any problems during the rental period which could not be solved by dealing directly with the local villa staff, Guests can contact IV or its local representative immediately and IV will use its best endeavours to rectify the situation. It is understood that infrastructure, local standards and conditions are often of a less developed nature in a remote resort location than in more urban environments. IV will do as much as can be reasonably expected to avoid and rectify any problems that may occur, but cannot be held responsible for any problems beyond its control.
Any complaints must be notified to IV or its local representative within 24 hours of the occurrence giving rise to the complaint, and must then be notified in writing to IV before departure. Should a problem that has been notified remain unsolved please make a complaint in writing to IV within 14 days of the completion of the rental period. If the Villa is vacated before the end of the rental period without mutual agreement this may result in the loss of all rights to compensation.
No complaint will be considered if made after the departure date or if not acknowledged by the villa owner, IV or the local representative.
PERSONAL DATA PROTECTION
The Client and/or Guests hereby acknowledge and agree that personal data (e.g. name, age, contact details, credit card details) given to IV are collected and used for any or all of the following purposes:
• Performing obligations in the course of or in connection with provisions hereunder;
• Verifying client and/or Guests’ identity;
• Responding to, handling, and processing queries, requests, applications, complaints, and feedback from the client and/or Guests;
• Processing payment or credit transaction;
• Complying with any applicable laws and regulations or to assist in law enforcement and investigations conducted by any governmental and/or regulatory authority;
• Legitimate and public interests;
• Any other purposes for which the client and/or Guests have provided to IV the information.
The client and/or Guests agree that IV may disclose their personal data for the following purposes:
• Where such disclosure is required for performing obligations in the course of or in connection with provisions hereunder;
• Legitimate and public interests;
• Obligations to third-party service providers, agents and other organisation as required by applicable laws.
The consent of the client and/or Guests to the collection, use and disclosure of personal data hereunder, shall remain valid until such time it has been withdrawn by the client and/or Guests in writing, or twelve (12) months after the termination of these Terms and Conditions. Any request made by the client and/or Guests to IV to stop using and/or disclosing personal data for any or all of the purposes listed above shall be submitted to IV in writing.
Any contract that is made will be with the acceptance by both parties of these terms and conditions, which are governed by the law of Hong Kong law and Hong Kong courts shall have jurisdiction in relation to any claim or dispute arising out of, or connected with them.
If any of the conditions of this Rental Contract are or become or are deemed to be invalid, or if there is any omission from any terms and conditions, the remaining terms and conditions will remain valid and enforceable and cannot be contested.
The company reserves the right to change prices, terms and conditions with prior notice.
I/We agree to the above terms and conditions have been read, understood and have been accepted and do hereby agreed to the application of the above Terms and Conditions to our reservation.
